Motion filed by embattled CJN dismissed by Nigeria's Court of Appeal
Nigeria's appellate court, the Court of Appeal sitting in Abuja, has dismissed the motion filed by suspended Chief Justice of Nigeria, Justice Walter Onneghen seeking for a stay of proceedings of his trial at the Code of Conduct Tribunal. The appellate court ruled that the evidence presented by Onneghen's lawyer does not suffice as a request for the stay of execution lacks the backing of legal provisions on the reason it should be granted. Justice Onneghen has been undergoing trial at the CCT over allegations of partial and non-declaration of his assets. Onneghen's lawyer brought the application before the appellate court as a result of the ICCT's refusal of the request challenging the tribunal's jurisdiction to hear the case alongside other motions before proceeding with the main trial. However, the tribunal due to an order by the Court of Appeal has postponed the hearing indefinitely.
